This is the privacy policy ("Privacy Policy"), effective January 1, 2010, for NetQast Media, Inc. ("NetQast", "NetQast.com" "our", "we", "us"). This Privacy Policy sets forth our policies regarding the collection, use and disclosure of certain information relating to your use of NetQast.com (the "NetQast Services"), including but not limited to delivery via our Website [http://www.netqast.com] (the "Site"), a mobile device, or otherwise.

We recognize the importance of protecting your privacy and our Privacy Policy is designed to assist you in understanding how we collect, use and safeguard the personal information you provide to us, and to assist you in making informed decisions when using the NetQast Services. This Privacy Policy will be continuously assessed against new technologies, business practices and our customers' needs. As we update and diversify our services, this Privacy Policy may evolve. Please check this page for updates periodically. Regardless of later updates, we will never use the information you submit under this current policy in a new way without first providing you an opportunity to opt-out or otherwise prevent that use.

We are committed to protecting your privacy and respect your privacy concerns. Ensuring your understanding of how we collect, use and maintain your information is important to NetQast. In short, this privacy policy is intended to explain our privacy practices and inform you as to:

  • the types of information we collect from you and how that information is collected;
  • how we use such information;
  • the circumstances under which we disclose such information to others;
  • the choices you have regarding our use of, and your ability to modify, such information; and
  • the mechanisms we have implemented designed to protect your personally identifiable information.

Information We Collect

We collect information about you when you visit and use our site and services (collectively, the "Site"), and particularly when you enter or input information, whether during the course of entering, initiating, fulfilling and transmitting information or otherwise in connection with your general activities and/or use of the Site. You can visit the Site and learn about NetQast, our related products and services, and find out how to contact us without giving us any personally identifiable information.

We collect personally identifiable information from you in a variety of contexts. For example, you may be required to provide such information to us if you: (1) complete an online registration form (e.g., various sign-up forms for receiving email newsletters, registering for special offers, promotions or programs, registering for an account, entering a contest/sweepstakes or responding to a survey); (2) fill out an order form to request information; (3) register to participate in message boards, blogs and chat rooms (if any) and other community features; or (4) purchase any products or services from us. Such information may include your name, email address, mailing address and zip code, date of birth, phone number, and, where appropriate, a valid credit card number with expiration date. Of course, you never have to answer any of the questions we ask you (nor choose to view or listen to any multimedia content or otherwise interact with our Site), but refusal to do so may limit the products or services we can offer or provide to you.

We automatically track certain information. We use what are commonly called "cookies," a small data string our server writes to your hard drive, which allows NetQast to identify you as a valid registered user or member so that we can deliver music to you and to ensure that no one else can sign on simultaneously with your account from another computer. Currently this is the only area where we use cookies.

If you choose to post messages to our message boards, chat rooms or other message areas or leave feedback for other users, we will collect that information you provide to us. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems, and as otherwise permitted by law.

If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site, we may collect such information into a file specific to you.

Our Use of Your Information

We use your information to facilitate the provision of services you request. When you purchase products or services from NetQast, we will use your personally identifiable information to process and fulfill your order and for customer service purposes. Many online customers are particularly concerned about their credit card information, which we will share only as required by companies involved in your transaction (e.g., credit card processing). We do not rent, sell or share credit card information with promotional partners or other third parties.

We may also use the information we collect about you to analyze Site usage, improve our content and product offerings, customize the Site's content, layout, and services, update you about our products or services, or to contact you about exciting offers of new products or services that we believe may be of interest to you.

In order to keep our registered users and subscribers informed about the Netast Services' latest developments and features, we may send messages to your personal email address that you provided to us while registering for the NetQast Services.

You are always free to contact us with a question or problem related to your use of the NetQast Services. Our standard business practice is to retain any communications from our registered NetQast Services users, members and Site visitors to help us to serve each of you better.

Bulletin Boards/Chat Rooms/Blogs

If you use a bulletin board, blog or chat room on this site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums.

This Web site contains links to other sites that are not owned or controlled by NetQast. Please be aware that we are not responsible for the privacy practices of such other sites.

We encourage you to be aware when you leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information.

This privacy statement applies only to information collected by this Web site.

Correcting/Updating/Deleting/Deactivating Personal Information

If a user's personally identifiable information changes, (such as zip code, phone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users' personally identifiable information. This can be done by logging into your user account and updating your personal information or discontinuing service at anytime.

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with an appropriate law enforcement investigation, current judicial proceeding, a court order or legal process served on our Web site.

Third-party information provided to us

Links: When using our NetQast Services, you may click through certain links or promotions that will enable you to purchase products or use services provided by our Partners. Some of these Partners may share certain information that you provide to them with us. By clicking on and through to a link or promotion via the NetQast Services, you agree to allow us to receive and use any information (except for credit card information) that you may provide to our Partners, under the same terms and conditions as if you provided your information directly to us. We are not, however, responsible for any other Web sites or services, or their respective privacy policies or how they treat information about their members. We strongly advise you to check their privacy policies to find out how they are treating your personal information.

Third Party Usage: NetQast is not responsible for, and will assume no liability, if a Partner or other Web site or entity collects, uses or shares, any information about you in violation of its own privacy policy, or applicable law.

When and with whom we may share your information

Other than as set forth in this Privacy Policy, we do not share your personal information with other companies. While we may use personal information (such as age, gender or personal usage data) to display advertising to registered users, we do not share personal information with our advertisers.

Vendors: We will share your personal information with companies acting as our agents in providing our service (e.g., credit card processing, customer/support services) to you, all of whom agree to use it only for such specified purposes. Each vendor must also agree to keep your personal information reasonably secure and confidential in accordance with applicable laws.

Legally affiliated entities: In the event that NetQast is merged with another entity, or in the event of a transfer of our assets, Site or operations, NetQast may disclose or transfer your personal information in connection with such transaction. In the event of such a transfer, NetQast will notify you via email or by posting a prominent notice via the NetQast Services for 30 days of any such change in ownership of NetQast resulting in a change of control of your personal information.

Legally compelled disclosure: We will also disclose your personal information when required to do so by law, for example, in response to a court order or a subpoena or other legal obligation, in response to a law enforcement agency's request, or in special cases when we have reason to believe that disclosing your personal information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (whether intentionally or unintentionally) our rights or property.

Bankruptcy: You should also be aware that courts of equity, such as U.S. Bankruptcy Courts, may have the authority under certain circumstances to permit your personal information to be shared or transferred to third parties without your permission.

Security

NetQast endeavors to protect the security of your personal information and your choices for its intended use. We use secure SSL technology to protect the transmission of sensitive personal information such as your credit card number. We store your personal information on a secure server, and use procedures designed to protect the personal information we collect from loss, misuse, unauthorized access or disclosure, alteration or destruction.

Although we will take (and require our third-party providers to take) commercially reasonable security precautions regarding your personal information collected from and stored by the NetQast Services, due to the open nature of the Internet, we cannot guarantee that any of your personal information stored on our servers, or transmitted to or from a user, will be free from unauthorized access, and we disclaim any liability for any theft or loss of, unauthorized access or damage to, or interception of any data or communications. By using the NetQast Services, you acknowledge that you understand and agree to assume these risks.

Email is not recognized as a secure medium of communication. For this reason, we request that you do not send any personal information to us by email. However, doing so is allowed, but at your own risk. We follow commercially reasonable security precautions to protect the personal information submitted to us, both during the transmission and once we receive it.

Compromise of personal information

In the event that personal information is compromised as a result of a breach of security, NetQast will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.

Modification of your choices and preferences

You may modify your registration information at any time by following the instructions provided in the account management area of our Site.

Notifications of Changes

It is NetQast's policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to users via email or through conspicuous posting of such notice on our Site, as determined by NetQast in its sole discretion. NetQast reserves the right to determine the form and means of providing notifications to our users.

If we decide to change our privacy policy, we will post these changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. If you do not agree to this Privacy Policy, please do not use the NetQast Services. Members and visitors are encouraged to review this Privacy Policy from time to time.
